"Obstructions of Justice: A Look at the Problems and Solutions to Prosecuting Human Trafficking Cases"

Investigating and prosecuting labor traffickers is difficult due to the undocumented status of the majority of labor trafficking victims. Many victims are subjected to deportation who cannot meet the legal threshold the Congressional Trafficking Victims Protection Act establishes for full cooperation with legal authorities in the investigation and litigation of their case. Moreover, where many states have statutes forbidding sex trafficking, few states have any laws defining and prohibiting labor trafficking. Therefore, district attorneys are reticent to file state charges for cases they receive from law enforcement of labor trafficking.
